What Severn DUI Records Show

A DUI record from Severn contains information about the arrest and the court case. Each record is different, but most include the same core details.

Court records for Severn DUI cases typically show the full name of the person charged, the date and location of the arrest, the specific charges filed, each court hearing date, the judge assigned, and the final outcome. If the person was convicted, the record shows the sentence. If the case was dismissed or the person was found not guilty, that outcome is also on record. For cases that ended in probation before judgment (PBJ), the case still appears in court records, though it is treated differently than a conviction for some legal purposes.

DUI arrest records from Severn may also include the blood alcohol content (BAC) reading at the time of the stop, whether a breath or blood test was given or refused, and whether the license was suspended under the administrative per se process. These details come from police reports, which are separate from court records. You can request police records from the Anne Arundel County Police Western District.

Note: Some Severn DUI records may have restricted information, especially if the case involved a minor or if the court ordered certain details sealed.

Getting Copies of DUI Records

You can get copies of Severn DUI court records in person or by mail. In person is faster. Go to the District Court in Glen Burnie or the Circuit Court in Annapolis depending on which court handled the case. Bring a government-issued ID and the name or case number you are looking for. Staff will search the records and make copies for you. The fee is $0.50 per page for plain copies. If you need a certified copy, the certification fee is $5.00 on top of the copy cost.

Mail requests are also accepted. Write to the clerk at the court where the case was heard. Include the full name, approximate dates, and any case number you have. Send a check or money order for the copy fees. Processing times vary, but you can expect a few weeks for mail requests. If you need records faster, the in-person option is better. For arrest records rather than court records, contact the Anne Arundel County Police Western District at 410-222-6155 ext. 112. They handle requests for police-generated DUI reports from Severn.

Maryland DUI Laws That Apply to Severn Cases

Maryland uses two main charges for impaired driving. Transportation Article Section 21-902 covers both. A DUI charge under Section 21-902(a) applies when a driver's BAC is 0.08 or higher. A DWI charge under Section 21-902(b) applies when the BAC is 0.07, or when a driver shows impairment even below 0.08.

The penalties for DUI in Maryland are set by state law. A first DUI offense can bring up to one year in jail and a fine of up to $1,000. The driver also gets 12 points on their license, which can lead to revocation. A second offense raises the jail time to two years with a mandatory minimum of five days. Fines go up to $2,000. A third offense means up to three years in jail and a $3,000 fine. DWI carries lighter penalties on paper, but a first offense still brings up to two months in jail and 8 points on the license. Two DWI convictions within five years can trigger mandatory ignition interlock under Noah's Law. All of these outcomes are recorded in court records, which become public documents in Severn and across Maryland.

Maryland's impaired driving laws also include a zero tolerance rule for drivers under 21. Any detectable alcohol in a minor driver's system counts as a violation. DUI charges involving a minor passenger in the vehicle bring additional fines and possible jail time on top of the base charge.

The Maryland MVA page on impaired driving laws provides useful background on how the state handles DUI cases statewide.

Expungement of Severn DUI Records

Some Severn DUI records can be expunged under Maryland law. Criminal Procedure Section 10-105 sets out the rules for expungement in Maryland. Not every outcome qualifies. A DUI case that ended in a not guilty verdict or a dismissal is eligible for expungement. A nolle prosequi, which means the state chose not to prosecute, is also eligible, but it is not automatic. You have to file a petition with the court.

As of October 1, 2024, Maryland law allows DUI probation before judgment (PBJ) records to be expunged after 15 years. This applies to cases under Section 21-902(a) and 21-902(b), which are the alcohol-related charges. It does not apply to drug-related DUI charges under subsections (c) and (d). If you received a PBJ for a Severn DUI, you may be able to clear that record after 15 years from the date you completed probation, as long as you have not had another conviction in that time. A guilty verdict for DUI or DWI cannot be expunged under current Maryland law. The expungement petition fee is $30, and fee waivers are available for those with financial hardship.

The People's Law Library has free information on DUI charges, expungement eligibility, and the process for filing a petition in Maryland courts.

Note: Expungement removes the record from public court databases, but it does not erase records held by some law enforcement agencies or federal systems.
