Expungement of Wheaton DUI Records

Maryland allows some Wheaton DUI records to be expunged under Criminal Procedure Section 10-105. Eligibility depends on the case outcome. Not guilty verdicts, dismissals, and nolle prosequi cases may qualify. A nolle prosequi requires a filed petition. A stet is eligible after three years. None of these are automatic. Under changes that took effect October 1, 2024, DUI cases that ended in probation before judgment are now eligible for expungement after 15 years. The 15 years starts from the date probation ended.
