Expungement of Wheaton DUI Records
Maryland allows some Wheaton DUI records to be expunged under Criminal Procedure Section 10-105. Eligibility depends on the case outcome. Not guilty verdicts, dismissals, and nolle prosequi cases may qualify. A nolle prosequi requires a filed petition. A stet is eligible after three years. None of these are automatic. You have to file the petition at the Montgomery County court where the case was heard.
Under changes that took effect October 1, 2024, DUI cases that ended in probation before judgment are now eligible for expungement after 15 years. The 15 years starts from the date probation ended. This applies only to charges under Section 21-902(a) and (b), the alcohol-related charges. Drug-related DUI under (c) or (d) does not qualify. No new convictions are allowed during the 15 years. A Wheaton DUI guilty verdict still cannot be expunged under current Maryland law. The petition fee is $30 per case, and fee waivers are available.
