What Baltimore County DUI Records Show
A Baltimore County DUI record pulled from Case Search includes personal identifying data for the defendant: name, date of birth, address, physical description including height, weight, race, and gender. The arresting officer's name and badge ID appear in the record. The time, date, and exact location of the traffic stop in Baltimore County are part of the record as well. Vehicle license and description may appear for traffic-related DUI charges.
The charge field shows the specific statute. Transportation 21-902(a) is DUI at a BAC of .08 or higher. 21-902(b) is DWI at .07. Drug-related driving impairment falls under 21-902(c) or (d). The disposition tells you how the case ended. Outcomes include guilty, not guilty, probation before judgment, nolle prosequi, stet, and dismissed. For cases that ended in certain ways, like a dismissal or nolle prosequi, the record may stop appearing publicly after three years.
DUI Laws in Maryland and Baltimore County
All DUI and DWI prosecutions in Baltimore County follow state law. The main statute is Transportation Article 21-902. A DUI means a BAC of .08 or higher. A DWI is .07. Each generates a court record that shows up as a Baltimore County DUI record in Case Search. The criminal penalties are set at the state level and apply uniformly across counties.
A first DUI conviction brings up to one year in jail and a fine up to $1,000. A second DUI within five years can add mandatory jail time of at least five days. Three DUI convictions can mean up to three years. Repeat offenders must install an ignition interlock device under Noah's Law, which is administered by the MVA. More on the ignition interlock rules is at mva.maryland.gov/drivers.
The administrative side of a Baltimore County DUI arrest is separate from the criminal case. The officer confiscates the license and issues a 45-day paper license. The driver must request an MVA hearing within 10 days to avoid an automatic license suspension starting on day 46. That request goes to the MVA Office of Administrative Hearings with a $150 fee. Details are at mva.maryland.gov.
DUI convictions in Baltimore County add 12 points to the driving record. DWI adds 8. Those points stay on the MVA record for two years from the date of the violation. The court record and the MVA record are both separate from each other and both can affect the driver independently.
Expungement of DUI Records in Baltimore County
Maryland law under Criminal Procedure 10-105 sets the rules for expunging DUI records. Baltimore County DUI convictions cannot be expunged. Cases that ended in not guilty, dismissal, or nolle prosequi can be expunged. A stet disposition becomes eligible after three years. Beginning October 1, 2024, a DUI probation before judgment (PBJ) on an alcohol charge under 21-902(a) or (b) can be expunged after 15 years, assuming no new convictions in the interim.
To file for expungement, get the petition form from the Circuit Court Clerk's Office at 401 Bosley Avenue, Towson, or download it from courts.state.md.us/courtforms. File the petition in the court where the Baltimore County DUI case was decided. The filing fee is $30. Fee waivers are available. You must also serve a copy on the Baltimore County State's Attorney's Office. If the State's Attorney objects, the court will schedule a hearing. More information on the expungement process is at peoples-law.org.
Note: Even after an expungement is granted, some state agencies retain restricted access. The public record in Case Search will no longer show the case, but it does not disappear from all government systems entirely.
