Getting Copies of Allegany County DUI Records

Maryland DUI Laws That Apply in Allegany County

Maryland draws a clear line between DUI and DWI. A DUI charge under Transportation 21-902(a) applies when a driver's BAC is .08 or above. A DWI charge under 21-902(b) applies at .07. Both can result in criminal records, license points, and court appearances in Allegany County.

The penalties differ between the two. A first DUI offense can bring up to one year in jail and a fine up to $1,000. A first DWI offense carries up to two months and a $500 fine. A second DUI within a certain period may require a mandatory ignition interlock device under Noah's Law. The MVA handles the administrative side of a DUI arrest separately from the criminal case. If you fail or refuse a breath test, the officer takes your license on the spot and issues a 45-day paper license. You have 10 days to request an MVA hearing to challenge the suspension. A DUI conviction adds 12 points to your Maryland driving record. A DWI conviction adds 8. Those points stay on the record for two years from the violation date. Enough points can trigger a license suspension or revocation. The court record and the MVA record are separate, and both can affect someone convicted of DUI in Allegany County.

Note: Maryland's implied consent law means any licensed driver in the state has already agreed to submit to a breath or blood test if stopped on suspicion of DUI. Refusing that test carries its own penalties separate from the criminal charge.

Expungement of Allegany County DUI Records

Not all DUI records in Allegany County can be removed from public view. The rules under Criminal Procedure 10-105 control who qualifies. A DUI conviction, meaning a guilty verdict, generally cannot be expunged in Maryland. Cases that ended in a not guilty verdict, dismissal, or nolle prosequi are eligible for expungement. A stet is eligible after three years.

A new law effective October 1, 2024 changed the rules for probation before judgment (PBJ) on DUI charges. Under the old rules, a DUI PBJ could not be expunged. Now, a PBJ for alcohol-related DUI under 21-902(a) or (b) can be expunged after 15 years from discharge off probation, as long as there is no new conviction during that time. Drug-related DUI charges under 21-902(c) or (d) are still not eligible.
